These Terms of Use govern your access to and use of SwarpPay websites, platforms, portals, and related services that link to these Terms, including swarppay.com, giftcard.swarppay.com, merchant.swarppay.com, and master.swarppay.com.
By using SwarpPay, you agree to these Terms. If you do not agree, you should not use the website or services.
1. About SwarpPay
SwarpPay provides a digital platform for access to digital products, vouchers, prepaid products, merchant tools, reseller services, dashboards, and related digital value distribution features. SwarpPay may make different services available to consumers, merchants, resellers, distributors, partners, and internal operators.
Some products or services may be provided by third-party suppliers, issuers, merchants, payment providers, infrastructure providers, or commercial partners. Product availability may vary by country, user type, partner status, regulatory status, and operational approval.
2. Services covered by these Terms
These Terms apply to the public website and to SwarpPay services that link to these Terms. Services may include digital gift cards and vouchers, telecom top-ups, prepaid products, gaming, streaming, retail, utility, and digital product categories, merchant and reseller portals, catalog, dashboard, reporting, fulfillment, redemption, and reconciliation tools, partner or operator dashboards, customer support, onboarding workflows, and future products where legally available and expressly launched.
Additional product-specific, merchant-specific, reseller-specific, or partner-specific terms may apply. If separate terms apply to a specific service, those terms will control for that service.
3. Eligibility
You may use SwarpPay only if you are legally able to enter into a binding agreement. If you use SwarpPay on behalf of a company, shop, reseller, merchant, distributor, or other organization, you confirm that you are authorized to act on its behalf. Merchant, reseller, distributor, and dashboard access may require approval, verification, and additional onboarding.
4. Accounts and access
Some services may require an account. You are responsible for keeping login credentials secure, providing accurate and current information, not sharing restricted dashboard access, and notifying SwarpPay immediately if credentials may be compromised. SwarpPay may apply access controls, verification checks, risk reviews, and security restrictions.
5. Digital products, vouchers, and prepaid products
Digital products may include codes, vouchers, top-ups, prepaid value, digital delivery products, or similar items. Product descriptions, redemption rules, geographic restrictions, expiry dates, fees, supported currencies, and refund rules may vary by product or issuer. You are responsible for checking product details before purchase or resale.
Once a digital code, voucher, or prepaid product has been delivered, it may not be cancellable, refundable, or exchangeable unless required by law, confirmed as defective, or expressly allowed by product-specific terms. SwarpPay is not responsible for misuse, loss, incorrect recipient details, unauthorized sharing, or redemption of delivered codes where the product has been correctly supplied.
6. Merchant and reseller use
Merchants and resellers may use SwarpPay to access digital product catalogs, sell eligible products, track activity, and manage customer transactions where approved.
Merchants and resellers must use the platform lawfully and honestly, provide accurate business and contact information, sell only through approved channels, comply with pricing, branding, customer communication, and product rules, avoid misleading customers, maintain appropriate records, and cooperate with verification, fraud prevention, compliance, and support requests.
SwarpPay may suspend merchant or reseller access in cases of suspected fraud, misuse, customer harm, non-payment, regulatory concern, chargeback abuse, unauthorized resale, or breach of these Terms.
7. Payments, pricing, and settlement
Prices, fees, commissions, margins, payment methods, settlement timelines, and available currencies may vary by product, user type, merchant type, country, and agreement. Taxes, duties, telecom fees, issuer fees, payment provider fees, exchange rates, or other charges may apply. Merchant or reseller settlement terms may be governed by separate commercial terms or agreements.
8. Future financial products
Some SwarpPay materials may refer to future products such as cards, wallets, diaspora-linked spending, payment services, or regulated financial infrastructure. Unless expressly stated on an active product page, these products are roadmap initiatives and may not yet be available.
SwarpPay does not provide banking, deposit-taking, credit, insurance, investment, remittance, or regulated payment services unless such services are expressly launched and provided either directly under applicable authorization or through an approved regulated partner. Nothing on the website is financial, investment, legal, tax, or regulatory advice.
9. Prohibited use
You must not use SwarpPay to commit fraud, launder money, evade sanctions, abuse promotions, vouchers, refunds, chargebacks, or reseller terms, use stolen payment methods or unauthorized accounts, resell products outside approved channels, misrepresent SwarpPay or its partners, interfere with security or availability, scrape, copy, reverse engineer, attack the platform, upload malicious code, attempt unauthorized access, violate applicable law or third-party rights, or harm customers, merchants, partners, or the platform reputation.
10. Compliance and verification
SwarpPay may conduct verification, fraud prevention, sanctions screening, transaction monitoring, merchant due diligence, or other checks where required or appropriate. We may request additional information and may delay, reject, cancel, restrict, or report activity where we believe it may breach law, policy, partner rules, issuer rules, or these Terms.
11. Third-party products and links
SwarpPay may link to or provide access to third-party products, websites, issuers, payment providers, supplier systems, or partner services. Third-party services are governed by their own terms and policies.
12. Intellectual property
The SwarpPay name, SWARP name, logo, website content, design, software, interfaces, trademarks, graphics, and platform materials belong to SwarpPay or its licensors. You may not copy, modify, distribute, reverse engineer, sell, or exploit SwarpPay content or technology without written permission.
13. Website content and service availability
Website content is provided for general information. Product availability, pricing, features, categories, partner access, and launch timelines may change. SwarpPay may update, suspend, restrict, or discontinue any part of the website or services at any time.
14. Limitation of liability and indemnity
To the maximum extent permitted by applicable law, SwarpPay is not liable for indirect, incidental, special, punitive, or consequential losses. Nothing limits liability where it cannot legally be limited. Business users agree to indemnify SwarpPay against claims arising from breach, misuse, unlawful activity, customer misrepresentation, or unauthorized resale.
15. Changes, governing law, and contact
